Rules and conditions for the registration of gTLD domain names
Basic concepts
ICANN (Internet Corporation for Assigned Names and Numbers) is a non-profit organization that is responsible for the DNS namespace, distribution of large blocks of IP addresses, management of autonomous system numbers, etc. ICANN delegates authority for the management of individual TLDs to other entities (registries).
Accreditation means the identification and establishment of minimum requirements for the operation, management and registration of a domain name to persons or entities that meet these requirements (standards).
The registrar is authorized to manage its domains in a central registry. It enables their registration and management by end customers (domain owners). One of the registrars is WEDOS Internet, a.s.
The registry is the main database of domain names, their holders and other data. These registries are entrusted with the management of specific TLDs (extensions). An example is CentralNic for domains with the ending ONLINE, WEBSITE and others.
A TLD (Top Level Domain) is the top-level domain listed at the end of a domain name. E.g. com. It is divided into ccTLDs (Country code TLDs), which are regional domains (e.g. CZ), or gTLDs (generic TLDs), which are not associated with a specific country (com, net, org, info, biz, etc.).
RDAP (formerly WHOIS) is a service that provides information about domains, their contacts, nameservers and other data associated with the domain.
Personal data is data that identifies persons or entities.
A registered domain name is a domain name, a unique name for computers and servers on the Internet, under which is hidden their numerical value (IP address) through which the computers communicate. A domain name is a numeric name easier for humans to remember. A domain can have multiple levels that are separated by a period, e.g., the third-level domain kb.wedos.com
The domain owner is the holder of the domain name.
1. Parties to the contract
1.1 The Domain Name Registration Terms and Conditions (hereinafter referred to as the ‚gTLD Terms‚) are concluded between the domain name applicant, i.e. the natural person or entity (hereinafter referred to as the ‚Customer‚) applying for the domain name registration, and the registrar WEDOS Internet a.s., Masarykova 1230, 373 41, Hluboká nad Vltavou Czech Republic (hereinafter referred to as the ‚Operator‚).
1.2 The Operator is a domain name registration company accredited by the Internet Corporation for Assigned Names and Numbers, known as ICANN. Therefore, we declare that we are acting within the framework of the contract concluded between ICANN and the Operator (WEDOS Internet a.s., Masarykova 1230, 373 41, Hluboká nad Vltavou Czech Republic). Therefore, you should note that the gTLD Terms may change over time to be consistent with the agreement with ICANN or any modification to ICANN policies that we are required to follow.
The contractually binding terms and conditions include:
- Registrar Accreditation Agreement – www.icann.org/en/about/agreements/registrars
- Policy compliance: www.icann.org/en/resources/registrars/consensus-policies
- All additional rules: www.icann.org
1.3 By checking ‚I agree to the Domain Name Registration Terms and Conditions‚ on the domain name registration order form on the Operator’s website, you signify your agreement to these gTLD Terms and Conditions and all policies, rules, regulations and procedures established by ICANN.
1.4 In the event of any conflict between the gTLD Terms, ICANN Terms, or Registry Terms (e.g., CentralNic, Verisign), the order of priority is as follows: (1) ICANN Terms; (2) Registry Terms; (3) gTLD Terms.
2. Collection and processing of personal data
2.1 If the Customer registers and manages domains in the name of a third party (the Domain Owner), the Customer must ensure that the consent of that party to these Terms is obtained. Upon request, the Customer shall then provide such consent, otherwise the domain name may be cancelled without refund.
2.2 As part of the domain name registration process, the Registry requires the following information:
- Last name, first name, mailing address, e-mail, valid phone number, fax number (if filled in) of the domain owner
- if the Domain Owner is an entrepreneur or a legal entity – the name of the company and full details of the person authorized to act for this entity
- IP addresses of the primary and secondary name servers for the domain name
2.3 The Operator shall store records relating to domain name registration applications as well as all domain names already registered, administered and renewed. We also store records relating to other services we provide. These records may include (but are not limited to):
- the date and time of domain name creation, domain name renewal and service request
- the date and time of the domain name application, renewal and service request
- communications relating to the dispatch, transmission, modification or termination of a service (or other related correspondence)
- the expiration date of the domain name
- information relating to any activity between the Customer and the Operator
The Operator may request any other relevant data for the purpose of facilitating the business relationship, which will be stored by the Operator.
2.4 As an accredited registrar, Operator is bound by its agreement with ICANN, its rules and policies. Selected registration data is therefore provided to third parties, such as domain registries, Data Escrow providers and ICANN, and may be made publicly available through the RDAP public service.
ICANN’s current policy allows the following to be published with the consent of the Domain Owner:
- Company name (if given)
- Name and surname
- Phone
- Fax (if indicated)
- Street and descriptive number
- City
- POSTCODE
By default, all personal information of the Domain Owner is hidden. The only exceptions are the following data, which are always public:
- Country
- Province/county (if specified)
2.5 Mediated Contact (P.O.C.). The email address of the Domain Owner is not published in the public domain records by default. To enable legitimate communication, the Operator provides a public mediated contact (e.g., a web form or anonymized email address) in accordance with ICANN policy. Messages sent through this contact are automatically forwarded to the domain Owner’s real email address. The Operator is not responsible for the content of these messages, does not check or filter them, and reserves the right to restrict this service in case of abuse.
2.6 By confirming these gTLD Terms and Conditions, the Customer agrees and confirms that he/she has been transparently informed about the collection and storage of personal data.
2.7 The Operator guarantees that any personal data provided will be used exclusively in the manner described above. Furthermore, the Operator guarantees that the personal data will not be transferred or disclosed to third parties other than the parties mentioned above.
3. Obligations of the domain name registrant
3.1 The Customer warrants and agrees that:
- all data and information provided by the Customer to the Operator during registration, maintenance, support and renewal of the domain name must be accurately, truthfully and completely;
- as soon as the contact or any other personal data of the Domain Owner changes, the Customer shall immediately update this data in the customer administration of the specific domain;
- if the Operator contacts the Customer with a request to update the personal data of the Domain Owner or data of a similar nature, the Customer is obliged to respond within fifteen (15) calendar days;
- the registration of the domain name must not have a negative impact or in any way infringe the rights of third parties;
- the registration of a domain name must not be directed towards illegal purposes and activities;
- the domain name must not be used in a way that violates any laws, regulations, rules or policies of the Registry (e.g. CentralNic, Verisign).
3.2 Intentionally providing incorrect personal information to a Domain Owner or refusing to update it may result in suspension or even revocation of the domain name in accordance with ICANN’s rules and policies.
3.3.If You do not respond to Operator’s inquiry within fifteen (15) calendar days due to an update of the Domain Owner’s personal information, Operator shall have the right to suspend or, in the last resort, cancel the Domain Name in accordance with ICANN’s rules and policies.
3.4 If the Operator determines that a domain name violates the rules, policies or rights in any way and the Customer fails to respond to the Operator’s requests, the Operator has the right to suspend or, in the extreme case, cancel the domain name in accordance with ICANN’s rules and policies.
3.5 The Customer shall ensure that the domain name does not violate any laws or rights of foreign persons, including translations of the website into foreign languages.
3.6 Individual registries may have their own rules that restrict the registration and/or use of the domain names they provide.
4. Domain Rules, Terms, Renewal and Protection Period
4.1 All domain name payments and fees are processed by the Operator. The domain name is registered for a fixed period of time selected in the domain order. If payment for the domain name is not received at the end of each registration period, the domain name will be suspended and deleted after the protection period
4.2 The Operator shall send at least 2 notices of domain name expiration before the domain name expires:
- first notice 30 days before expiry, together with a request for payment for renewal;
- second notice 1 week before expiry.
These notifications are sent by the system to the billing email specified for the domain. The customer should ensure that this email is available even if the domain associated with it expires.
4.3 If the Customer fails to renew the domain name in a timely manner, the Operator shall comply with the following policy:
- 8 days after the domain expires, the domain name is dropped from the DNS, but you can still renew it;
- 30 days after the domain expires, the domain name is deleted but can be renewed;
- 60 days after the domain expires, the domain name is cancelled and cannot be renewed;
- 65 days after expiration, the domain name is randomly released by the Registry for new registration
4.4.Renewal of the domain means payment of the renewal fee according to the valid price list on the Operator’s website: vedos.cz/domeny/doplnkove-sluzby/.
4.5 The Operator shall not be liable for the Customer and its domain renewal. The Customer is fully responsible for the renewal or renewal of his/her registered domain name
4.6 These gTLD Terms and Conditions are valid for the duration of the domain name registration. In the event that the Customer transfers the domain name to another registrar, the date of transfer shall be the last day of validity of these gTLD Terms. Please also note that a domain name cannot be transferred to another registrar unless a period of sixty (60) days has elapsed since the last change (registration, domain re-registration, change of Domain Owner).
5. Domain Name License
5.1 If the Customer licenses a domain name to a third party, the Customer will remain responsible for all obligations under the gTLD Terms and Conditions and the terms of the particular registry that manages the domain.
6. Domain Name Policy
6.1 The domain name should conform to the syntax established by ICANN. The same applies to any personal information that is required to register a domain name. Further information can be found on the official ICANN website: https://icann.org/policy
7. Violation of the gTLD Terms and Conditions
7.1 The following actions may lead to a violation of the gTLD Terms and Conditions and therefore to the suspension or even cancellation of the domain name:
- deliberate refusal to provide the Operator with accurate, true and complete information and to update it;
- a delay in responding to an Operator’s inquiry about domain information of more than fifteen (15) days;
- violation of the rules, principles or rights listed in Paragraph (3).
8. Dispute Resolution
8.1 Customer agrees to abide by all currently applicable domain name dispute resolution policies established by ICANN, in particular the Uniform Domain Name Dispute Resolution Policy (UDRP) and the Uniform Rapid Suspension System (URS). The current version of these and other relevant policies is available on ICANN’s website
8.2 The Operator shall comply with any changes to these policies. By continuing to use the Services after notification of a change, the Customer agrees to such changes. In the event of disagreement, the Customer has the right to transfer the domain name to another registrar or request cancellation
8.3 In accordance with the new Registration Data Policy (RDP), the personal data of the Domain Owner is not publicly available by default. However, in the event that a dispute is initiated under the UDRP or URS, the Operator is obliged to provide full and unresponsive registration data to the designated dispute resolution provider upon reasonable request.
9. Suspension and cancellation of domain names
9.1 As set out in Paragraph (3) Domain Name Registrant Obligations and Paragraph (7) Violation of the gTLD Terms, the following actions may result in a violation of the gTLD Terms and therefore a suspension or even cancellation of the domain name:
- deliberate refusal to provide the Operator with accurate, true and complete information and to update it;
- a delay in responding to an Operator’s inquiry about domain information of more than fifteen (15) days;
- violation of the rules, principles or rights listed in Paragraph (3).
9.2 In addition to the above, a domain name may be suspended or even revoked if:
- Customer fails to comply with policies established by ICANN and the Registry (e.g., CentralNic, Verisign), thereby materially violating these gTLD Terms;
- The domain name does not comply with the specifications and policies adopted by ICANN.
9.3 The Operator or Registry (e.g., CentralNic, Verisign) shall be entitled to correct errors, including but not limited to cancellation of a domain name within forty-five (45) days of registration, if the registration is the result of a prior erroneous cancellation or the domain name is in dispute. The Registry (e.g., CentralNic, Verisign) may cancel or transfer a domain name in its sole discretion to protect the stability of the Registry, to comply with all applicable laws, law enforcement requirements, or to avoid any civil or criminal liability on the part of the Registry and the Operator, including directors, officers, employees. The Operator and the Registry reserves the right to suspend a domain name during a dispute if the Customer uses the domain name to send unsolicited commercial advertisements in violation of applicable laws or customary acceptable policies, or if the Customer uses the domain name in connection with illegal activities.
9.4 The Operator may cancel a Domain Name upon notification issued by the relevant authority under the applicable laws in force
10. Limitation of liability
10.1 The Operator shall not be liable for:
- loss of the domain name for any reason other than negligence or misconduct on the part of the Operator;
- access delays, system errors, failures or interruptions;
- non-delivery or incorrect delivery of data between the Customer and the Operator;
- Events triggered by instructions from ICAN or Registry organisations (e.g. CentralNic, Verisign);
- any outstanding fees associated with the domain name;
- for loss of profit caused by any irregularity unrelated to negligence or misconduct on the part of the Operator
11. Compensation
11.1 By acknowledging these gTLD Terms, Customer agrees to indemnify, protect and defend ICANN, the Registries (such as CentralNic, Verisign) and the Operator, as well as the directors, officers, employees, partners and subcontractors of such organizations, from and against losses, claims, damages, liabilities, costs and expenses (including reasonable legal costs and expenses) arising out of or relating to the registration of the domain name, including:
- domain name registration and/or later use;
- Customer’s breach of any terms, conditions, rules or warranties of the gTLD Terms;
- violation of any third party rights by the Customer
12. Governing law and jurisdiction
12.1 These gTLD Terms and Conditions are governed by the laws of the Czech Republic. Any claims, disputes or other matters of a similar nature under the gTLD Terms shall be legally adjudicated according to the Customer’s address stored in the RDAP database at the time of application or the Operator’s address.
13. Final provisions
13.1 The gTLD Terms contain full details of the terms and conditions between the Customer and the Operator. The gTLD Terms supersede any written or oral agreements between the Customer and the Operator.
13.2 The Operator shall not be liable for any loss or damage arising from any delay in its delivery or performance, non-production, non-delivery, arising from any cause beyond its reasonable control. If any provision of these gTLD Terms and Conditions is held invalid or unenforceable for any reason, the remaining provisions shall remain valid and enforceable. If a court finds that any provisions of these gTLD Terms are invalid or unenforceable, but that limiting them would render them valid and enforceable, those provisions will be shown to be limited.
